BHP Billiton - Remote Login Terms of Use

1. Remote login terms of use

(a) You are remotely accessing the systems, applications, information, settings and associated data of BHP Billiton Group Operations Pty Ltd (BHPB, we or us) and its affiliates (collectively, the BHP Billiton Group) (BHPB Content).

(b) For the purpose of these terms and conditions (Terms of Use), any reference to “you” or “your” includes but is not limited to the owner and user of the computer, mobile or other device used to access the BHPB Content (the Device).

2 Acceptance of the Terms of Use

(a) These Terms of Use apply in addition to any other terms and conditions to which you are obliged to comply with.

(b) Access to and use of the BHPB Content is subject to these Terms of Use. BHPB reserves the right to amend these Terms of Use from time to time, including in relation to BHPB’s changing business or security needs and to ensure ongoing compliance by BHPB with legal, regulatory or policy requirements.

(c) By accessing and using the BHPB Content, you agree to be bound by these Terms of Use and any revisions to them as may be notified to you from time to time.

(d) You warrant to us that you are of legal age to form a binding contract and have authority to enter into these Terms of Use.

(e) Unauthorised or improper use of the BHPB Content (including, but not limited to, any use contravening the BHP Billiton Code of Business Conduct) or any breach of these Terms of Use may result in disciplinary action as well as civil and criminal penalties. This may include BHPB revoking your right to access BHPB Content remotely, counselling, a formal warning or termination of your employment or contract.

3 Your responsibilities

(a) BHPB Content contains confidential, proprietary, and other information protected by administrative, civil, and/or criminal penalties against unauthorised users. Access to BHPB Content is for authorised users only.

(b) You are responsible for the security, safe-handling and responsible use of any Device you choose to use for BHPB business purposes.

(c) You acknowledge that you are responsible for all activity that occurs on or in relation to your use of or access to the BHPB Content on your Device.

(d) You must not store, back up or transfer any BHPB Content on to a personal Device using any method, including but not limited to saving the BHPB Content locally to the device or through cloud based services, non-BHPB email accounts or by other means of transmission.

(e) You are under an obligation, and must use appropriate security measures, to safeguard BHPB Content.

(f) You must not share or allow any other person to use your BHPB login credentials or Device to access the BHPB Content.

(g) You must abide by all BHPB policies related to the security of BHPB Content and workplace behaviour in relation to the access and use of BHPB Content.

(h) BHPB does not provide support or assist with equipment configuration to enable remote access to the BHPB Content. For further assistance please refer to your Device’s user manual or contact your hardware provider.

4 Your privacy

(a) BHPB generally collects, inspects and processes employee and contractor personal information for purposes related to BHPB’s business operations and activities, including the management and maintenance of our workforce (where “processing” includes accessing, collecting, using, disclosing, copying, modifying, disposing of and any other activity that can be carried out in relation to the information), including through your use of BHPB Content. This will include but is not limited to your contact details, bank account details and HR records, as well as email communications sent and received by you.

(b) You have no explicit or implicit expectation of privacy when remotely accessing the BHPB Content. Any or all use of the BHPB Content may be intercepted, monitored, recorded, copied, audited, inspected and disclosed to authorised administrators, the BHP Billiton Group, its representatives, and law enforcement personnel, as well as authorised officials of other agencies, both domestic and foreign.

(c) As required by applicable data protection and privacy laws, BHPB takes steps to protect personal information against unlawful or unauthorised processing and against accidental loss, damage or deletion.
